• 2014 Is it Reasonable? A Legal Review of Warrantless Searches of Probationers and Parolees

  • Probationers and parolees have limited Fourth Amendment rights. A common condition of their supervision includes a waiver of the right to refuse consent to warrantless searches by probation/parole officers. In some jurisdictions, however, this provision is extended to law enforcement officers enabling police to conduct warrantless searches of probationers/parolees. In the case of U.S. v. Knights (2001), for example, the Supreme Court upheld the warrantless search of a probationer’s home by a police detective on the basis of a reasonable suspicion, a lower burden of proof than probable cause reserved for free citizens (Adelman, 2002). Further, in Sampson v. California (2006), the Supreme Court further reiterated that the Fourth Amendment protection against searches does not apply to parolees known to law enforcement officers, requiring even less grounds than a reasonable suspicion (Adelman, 2007). While some have provided a federal review of case law as it pertains to warrantless searches of probationers/parolees (Adelman 2002, 2007; Colbridge, 2003), there previously had been no comprehensive overview provided on state or local case law and its implications for a given jurisdiction. In addition to this legal review, implications for police-probation/parole partnerships will also be discussed.
• 2013 What is the Native Difference? Probation Supervision of Gang Affected Native American Youth

  • This webinar informs probation officers that supervise gang affected Native American youth about the unique aspect of this particular client. Gangs are a relatively new occurrence on Indian lands but the problem is growing quickly and is creating a significant impact on community safety and a burden on the tribal criminal justice system. Supervising gang affected youth is often treated as a specialty caseload in major jurisdictions, however tribal and rural agencies do not enjoy that luxury and must supervise them along with their general caseload. Because of historical trauma and the cultural and spiritual elements of the sovereign Indian nations, there are unique aspects to be considered when supervising native gang affected youth. These are presented in this program in order to better assist the probation officer in providing better supervision plans and outcomes for this special client. This information is also useful to non-tribal probation departments that supervise gang affected Native youth and encourages the development of partnerships and resource sharing with their tribal counterparts.
• 2013 Police-Probation/Parole Partnerships: Enhancing Reentry Accountability and the Need for Formalized Partnerships

  • In the early 1990s the public protection agenda was rapidly growing in political importance (Nash, 2008) and observers of criminal justice practices began to witness a “new” phenomenon in a number of sites throughout the United States: police-probation/parole partnerships. While partnerships of this nature – usually built on personal relationships – were not all that unusual during the 1950s, 1960s, and 1970s, over the past two decades the use of formalized police-probation/ parole partnerships has increased (Kim, Gerber, & Beto, 2010; Matz, DeMichele, & Lowe, 2012; Minor & Matz, 2012). However, many partnerships continue as informal networks between officers. This webinar will discuss the history and types of police-probation/parole partnerships that have existed, barriers to formalization, a review of the research, and potential dangers inherent in partnerships between law enforcement and community corrections agencies.
• 2013 Gang Awareness and Assessment in Rural Communities: Implications for Community Corrections

  • Historically, youth street gangs have been an urban phenomenon. Over the years, there has been growing concern that gangs may have increased their presence in rural communities and small towns. The National Gang Intelligence Center reports gang members are migrating from urban areas to rural and small towns for a variety of reasons, including expansion of lucrative drug markets, member recruitment, and avoidance of the law. However, findings from the National Gang Center’s National Youth Gang Survey raise doubts as to the prevalence of gangs in rural communities, suggesting overall decreases over recent years. Nonetheless, gangs in rural areas have been found to differ from their urban counterparts in several fundamental ways. For example, they are often less stable due to the smaller populations. An arrest of a prominent gang member has the potential to cause greater disruption in rural area gangs than in urban areas. In addition, street gangs may form briefly and then dissipate without formal responses. On the other hand, formal responses may have the unintended consequence of escalating the gang problem and fostering gang cohesion by reinforcing a gang identity (e.g., excessive media attention). This webinar will provide participants with information on identifying substantive gang problems, the distinction between urban and rural/small town gangs, the benefits of including gang membership in risk assessment, and strategies (e.g., OJJDP’s Comprehensive Gang Model, APPA’s C.A.R.E. Model) that can assist local community corrections agencies in the development of a response to gang problems.
• 2011 The APPA C.A.R.E. Model: Responding to Gang Violence in Reentry Planning (Part I & II)

  • Part one in the webinar series focuses on APPA’s Collaboration, Analysis, Reentry, Evaluation (CARE) model to address gang reentry. This webinar includes an overview of the CARE model and Project Safe Neighborhoods. Specifically, the webinar provides strategies for partnering with agencies inside and outside the justice system and helping gang-affiliated individuals return to the community following incarceration. These and other issues are discussed in this webinar.
  • Part two includes a brief review of the CARE model and Project Safe Neighborhoods (PSN). It then goes on to discuss the importance of problem analysis—identifying a given area’s crime problems in order to develop an appropriate response—and program evaluation, or assessing the success and vitality of that response.
    
• 2007 Supervising Gang Members in Rural Communities

  • Community corrections professionals who work in rural areas are increasingly likely to encounter gang members among the offenders they supervise. This training provides an overview of the scope of America’s gang problem and discusses the growth, influence and migration of gangs to rural parts of the country. It offers insight into the factors that are leading more people than ever before into the gang lifestyle and the impact of increased gang violence and narcotics trafficking on the quality of life in many communities. The presentation also profiles the major gangs operating across the country, describes gang identifiers, explains how gangs operate on the street, and discusses the correlation between prison gangs and street gangs. Also included are strategies for supervising gang members, tips for officer safety, and suggested interviewing techniques.
• 2006 Conducting an Effective Legal and Safe Search (Part1)

  • A primary element of PSN training is to teach or enhance firearm interdiction strategies while maintaining officer safety. This audio teleconference/webcast, the first of two, will look at the special issues of probation, parole, and community supervision officers conducting effective, legal and safe searches. Specific areas discussed include: the legal basis for conducting a search, the “Plain View Doctrine,” composition of a search condition, reasonable suspicion standard, reports and documentation, scope of the search, pre-search planning, search equipment, legal issue in conduction the search, avoiding becoming a “Stalking Horse,” and third party issues.

  • This audio teleconference/webcast is a continuation of the previous training and will look at the special issues of probation, parole, and community supervision officers conducting effective, legal and safe searches. Specific areas to be discussed include: safe & effective approach techniques, gaining entry, clearing the residence, dealing with stairways and attics, search tactics, if things go bad, preserving a crime scene, officers performance under stress, conducting the debriefing, the importance of dynamic training.
